1. Scope

These general terms and conditions (GTC) apply to all orders placed by customers resident in Switzerland through the caffe-billo.ch online shop operated by Il triangolo del gusto, Billo & co. KlG, Am Wasser 1, 8600 Dübendorf, +41 76 443 77 72, info@caffe-billo.ch (hereinafter referred to as www.caffe-billo.ch). www.caffe-billo.ch provides all services exclusively on the basis of these general terms and conditions. By placing an order, the customer expressly agrees to these GTC. They form an integral part of the contract between the customer and www.caffe-billo.ch.

2. Information on the website/offers/prices

2.1 www.caffe-billo.ch always endeavours to provide customers with the best possible information and guidance about the products and services offered. Some of the information on caffe-billo.ch is obtained directly from manufacturers or experts and is compiled by caffe-billo.ch in a clear, customer-friendly manner.

2.2 All information on caffe-billo.ch is provided without warranty, and all liability is disclaimed. To the extent permitted by law, www.caffe-billo.ch excludes in particular any warranty and liability for the accuracy, completeness and currency of the information on the website.

2.3 Prices and the product range are subject to change at any time. The colours shown in all product images and illustrations are not binding and may differ from the original. The technical descriptions of delivered products may differ from the manufacturer’s descriptions or the information published online.

2.4 Current prices are published online at www.caffe-billo.ch.

2.5 Prices are binding on both parties at the time of ordering. In the event of mistakes or errors in the stated price, however, www.caffe-billo.ch reserves the right to amend prices retrospectively. In this case, the customer will be informed and is not obliged to accept the products affected by the price change.

2.6 All prices are quoted in Swiss francs (CHF).

3. Orders/delivery

3.1 An order becomes binding for the customer when, at the end of the ordering process, they confirm it on the page showing the full order summary by clicking the button ‘Order with obligation to pay’.

3.2 Immediately after placing an order, the customer receives an acknowledgement email from www.caffe-billo.ch at the email address they provided. Until a separate order acceptance email has been sent to the customer, www.caffe-billo.ch reserves the right to reject the order or reduce the quantity ordered.

3.3 In particular, www.caffe-billo.ch reserves the right to reject an order if there is a legal dispute with the customer, especially in connection with outstanding payments for previous orders.

3.4 The customer is responsible for providing a complete and correct delivery address.

3.5 www.caffe-billo.ch delivers goods and vouchers within Switzerland.

4. Delivery and delivery times

4.1 Orders are processed within 24-48 hours of receipt. Delivery takes place within 1-3 working days.

4.2 www.caffe-billo.ch may only be held liable for delivery delays and their consequences to the extent that they were caused by a grossly negligent or intentional breach of contract by www.caffe-billo.ch.

5. Products delivered in error

Items delivered in error or in excess must be returned immediately in their original packaging, no later than within 7 days. All items not returned within this period will be invoiced. www.caffe-billo.ch bears the cost of returning goods sent in error. Return shipping costs are transferred to the customer in advance.

6. Vouchers

A maximum of one voucher may be redeemed per order. At the end of the ordering process, the voucher code is entered in the designated field. The corresponding amount is deducted directly from the current order. Vouchers exceeding the order value cannot be refunded.

7. Shipping costs

Shipping costs are CHF 9.90 per shipment. For orders with a value of CHF 75.- or more, after discounts and special offers have been deducted, shipping costs are covered by www.caffe-billo.ch.

8. Exclusion of warranty and liability

8.1 www.caffe-billo.ch warrants that products are undamaged at the time of dispatch. Products damaged during shipping will be repaired or replaced, at the discretion of www.caffe-billo.ch, provided that the customer notifies www.caffe-billo.ch of the defect by email within 7 days of receiving the goods.

8.2 Furthermore, www.caffe-billo.ch is liable to the customer for damages if and to the extent that such liability on the part of www.caffe-billo.ch is mandatory under the Product Liability Act.

8.3 Any further warranty for the products delivered and any liability for damage caused by these products are excluded, unless www.caffe-billo.ch fraudulently concealed the product defects concerned.

9. Right of withdrawal/right of return

9.1 Customers have the right to return goods within 14 days of delivery. The right of return is exercised by sending the goods back; no reason is required. Returns must be sent to:

9.2 Returned products or parcels will only be accepted in proper condition, i.e. unused, unopened, undamaged and in their original packaging. Clause 9.6 applies to damaged or defective products.

9.3 The customer bears the return shipping costs. Damaged or defective products under clause 9.6 are exempt.

9.4 Shipping costs of the original delivery are not refunded on returns. If delivery was free of charge (orders from CHF 75), a restocking fee of CHF 12.50 is deducted from the refund. Neither applies to damaged or defective products under clause 9.6.

9.5 Refunds are issued within 7 days of receipt of the returned goods.

9.6 Damaged or defective products: if the goods were damaged in transit or are defective, please notify us by e-mail within 7 days of receipt (clause 8.1). We will replace the goods or refund the purchase price. You will not incur any costs: we cover the return shipping, the restocking fee under clause 9.4 does not apply and clause 9.2 does not apply. Please contact us before sending anything back so that we can arrange the return.

10. Payment methods and invoicing

10.1 The following payment methods are available:

• By invoice

10.2 When paying by invoice, the QR-bill is included in the shipment. The invoice amount is payable within 5 days of receipt of the goods.

11. Data protection

11.1 Data required for business transactions is stored and processed for the necessary purposes and, where applicable, passed to affiliated companies or contractors as part of order processing. All personal data is treated confidentially.

11.2 www.caffe-billo.ch uses and processes personal data to maintain customer relationships.

12. Liability

12.1 Liability for product defects or damage caused by such defects is governed exclusively by clause 8. Damage arising from late delivery is governed exclusively by clause 4.

12.2 In all other respects, www.caffe-billo.ch excludes any other liability to the extent permitted by law.

13. Partial invalidity/preservation of validity

If any provision of these GTC is wholly or partially invalid, this does not affect the validity or purpose of the remaining provisions. The relevant statutory provisions apply in place of the invalid provisions.

14. Applicable law/jurisdiction

The contract is governed exclusively by Swiss law. The place of jurisdiction for all disputes with www.caffe-billo.ch is Zurich, Switzerland, subject to any differing mandatory jurisdictions under federal law.

15. Amendments to the general terms and conditions

www.caffe-billo.ch expressly reserves the right to adapt these general terms and conditions to the circumstances at any time and to apply them immediately to orders placed thereafter.
